Probate
The word “probate” has earned a negative connotation in modern parlance. Although most people are not sure what it means, they usually know that they wish to avoid it.
The meaning is relatively straight forward: when we are hired to handle a probate, we assist individuals with the transfer of assets from the dead to the living by court order.
Estate Planning
The term “estate planning” is self-explanatory; it involves organizing and structuring a person’s or a family’s personal and financial affairs. At the Law Office of Mario A. Pacione, we use estate planning tools to assist clients with a variety of issues.
When it comes to estate planning, studies show that the majority of Californians fail to do it. It is not an easy endeavor.
Trust Administration
“Estate administration” or “trust administration” is the process of carrying out a person’s planned wishes and administering his or her estate following his or her incapacity or death. It is the final winding down of a person’s final affairs and distributing his or her assets in accordance with his or her estate plan. An estate is usually administered by a person or entity (such as a bank, law firm or accountancy firm), who was chosen by the maker of an estate plan to execute the maker’s wishes and turn those wishes into reality. This is the “personal representative” of the estate.
Conservatorship
We represent persons seeking to help and protect loved ones who lack the ability or capacity to help themselves. Conservators manage the personal and financial care of dependent adults by court order.
